The following statutes address issues affecting how Virginia health insurance addresses conditions deemed as pre-existing:
In Virginia, health insurance companies are limited to a time frame of 12 months during which they can legally impose a pre-existing condition exclusion period. Health regulations in Virginia stipulate that medical conditions qualify as pre-existing if an individual obtained medical care for or was diagnosed with a particular condition within a 12 month period prior to the activation date of their new insurance plan.
In such cases that are deemed as pre-existing related, the applicantęs health insurance company, is relinquished from covering any medical costs related to the condition.
Once an individual satisfactorily completes a term for a pre-existing condition under one Virginia health insurance policy; should he\she opt to switch carries ęthe time spent without coverage can be credited from the old plan to the new one.
By law, Virginia health insurance companies are permitted to permanently exclude coverage for a pre-existing condition by attaching an elimination rider to an applicantęs policy.
